Terms of Service

1. Who we are

These Terms of Service ("Terms") govern your use of paintestimate.co and related services (together, "PaintEstimate", the "Service"). PaintEstimate is owned and operated by PURE SPECTRUM ("we", "us", "our"), with offices at 155 Office Plaza Dr, Ste A, Tallahassee, FL 32301, United States. By creating an account, submitting a quote request, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. What PaintEstimate does

PaintEstimate is an online service that lets homeowners and property managers ("Homeowners") describe a painting project and receive written quotes from independent painting businesses ("Painters"), and lets Painters review project details and submit quotes.

PaintEstimate is not a painting contractor. We do not perform, supervise, inspect, warrant or guarantee any painting work, and we are not a party to any agreement between a Homeowner and a Painter. Any contract for work is solely between the Homeowner and the Painter.

Sample quotes, cost ranges and estimates shown on the Service are illustrative only and are not offers, guarantees or professional assessments of any specific property.

3. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You agree to provide accurate, current information and to keep it up to date. You are responsible for keeping your password confidential and for all activity under your account. Notify us right away at support@paintestimate.co if you believe your account has been accessed without authorization.

If you request quotes for a property you do not own, you confirm that you are authorized by the owner to request quotes and arrange work.

4. Quote requests and matching

When you submit a quote request, we share the project details you provide (such as project type, size, surface condition, timing, photos, city and ZIP code) with up to four Painters who serve your area. We do not share your name, phone number or email address with a Painter unless you choose to connect with that Painter through the Service.

We do not guarantee that any Painter will respond, that you will receive a particular number of quotes, or that any quote will meet your needs. Quotes are prepared by Painters, who are solely responsible for their accuracy. Final pricing is typically confirmed by the Painter after an on-site walkthrough.

You are under no obligation to accept any quote.

5. Painters and their work

Painters are independent businesses, not employees, agents or representatives of PaintEstimate. Painters must confirm that they carry general liability insurance and hold any license or registration required where they work. We may review documents Painters provide, but we do not guarantee their licensing, insurance, qualifications, background or workmanship.

Before hiring a Painter, you should verify licensing and insurance directly (for example, by requesting a certificate of insurance), get the full scope, price, schedule, payment terms and warranty in writing, and avoid paying large deposits in advance of work. Any dispute about work, payment, damage or warranty is between you and the Painter.

Painters agree to provide accurate, itemized quotes, to use Homeowner information only to respond to that Homeowner's project, and to comply with all applicable laws, including consumer protection, home improvement and telemarketing laws.

6. Fees

Requesting and comparing quotes is free for Homeowners. Painters may pay PaintEstimate a fee to receive project details or submit quotes. Painter fees are described in a separate Painter agreement. We do not take payments for painting work through the Service.

7. SMS / text message terms

Program. PaintEstimate Account Notifications. If you opt in, PaintEstimate will send recurring automated service updates and account notifications by text message to the mobile number you provide, such as notices that a quote has arrived, that a Painter has replied to your question, or about changes to your request or account.

Consent. You opt in by checking the SMS consent box on our sign-up, quote request or contact forms. Consent to receive text messages is not required for purchasing products or services or for using the Service. You confirm that you are the account holder or authorized user of the mobile number you provide.

Frequency and cost. Message frequency varies based on your account activity. Message and data rates may apply according to your mobile carrier plan.

Opting out. You can cancel at any time by replying STOP to any message. You will receive one final message confirming that you have been unsubscribed, and no further messages will be sent unless you opt in again. You may also opt out by contacting support@paintestimate.co.

Help. Reply HELP to any message for help, or contact us at support@paintestimate.co or +1 (503) 331-1002.

Carriers. Mobile carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission from your carrier.

Privacy. Your mobile number and SMS opt-in information will not be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for details.

8. Email communications

By creating an account you agree that we may send you transactional emails about your account and quote requests. You may unsubscribe from any non-essential emails using the link in the message.

9. Your content and reviews

You keep ownership of photos, descriptions, messages and reviews you submit ("Your Content"). You grant PaintEstimate a non-exclusive, worldwide, royalty-free license to host, display and share Your Content as needed to operate the Service, including sharing project details and photos with Painters. Reviews must reflect your genuine experience with a Painter you actually hired. We may remove content that violates these Terms.

10. Prohibited conduct

You agree not to: submit false or misleading information or fake quote requests; impersonate any person or business; use Homeowner or Painter information for any purpose other than the project it relates to; contact Homeowners outside the Service before they choose to connect with you; post fake, paid or incentivized reviews; scrape, copy or resell data from the Service; interfere with the security or operation of the Service; or use the Service for any unlawful purpose.

11. Intellectual property

The Service, including its design, text, graphics, logos and software, is owned by PURE SPECTRUM or its licensors and is protected by intellectual property laws. You may not copy, modify or distribute any part of the Service without our written permission, except as needed to use the Service for its intended purpose.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THE QUALITY, SAFETY, TIMELINESS OR LEGALITY OF ANY PAINTER'S WORK OR QUOTE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PURE SPECTRUM AND ITS OWNERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY PROPERTY DAMAGE, PERSONAL INJURY OR LOSS ARISING FROM WORK PERFORMED BY A PAINTER. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.

14. Indemnification

You agree to indemnify and hold harmless PURE SPECTRUM from any claims, losses and expenses (including reasonable attorneys' fees) arising from your use of the Service, Your Content, your violation of these Terms, or any agreement or dispute between you and a Homeowner or Painter.

15. Dispute resolution and arbitration

Please contact us first at legal@paintestimate.co so we can try to resolve any concern informally. If we cannot resolve a dispute within 30 days, you and PURE SPECTRUM agree to resolve it by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Leon County, Florida, or by video conference. Either party may bring an individual claim in small claims court instead. You and we waive any right to a jury trial and to participate in a class action or class-wide arbitration. You may opt out of this arbitration agreement by emailing legal@paintestimate.co within 30 days of first accepting these Terms.

16. Governing law

These Terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law rules. Subject to Section 15, the state and federal courts located in Leon County, Florida have exclusive jurisdiction.

17. Changes and termination

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Continued use after the effective date means you accept the updated Terms. We may suspend or close accounts that violate these Terms. You may close your account at any time by contacting support@paintestimate.co.
